Unlimit Mobile — Terms and Conditions of Service (United States)

These Terms and Conditions (“Terms”) govern your purchase and use of wireless telecommunications services, SIM cards, eSIMs, devices, and related services (the “Services”) provided by Unlimit Mobile, a brand of Zetexa Global Corporation USA, a company organized under the laws of the State of Delaware (“Unlimit Mobile,” “we,” “us,” or “our”). Unlimit Mobile is a Mobile Virtual Network Operator (“MVNO”) and provides Services using the network infrastructure of T-Mobile Network (the “Host Network”), the identity of which is not disclosed under these Terms.

BY ACTIVATING A SIM CARD OR ESIM, CREATING AN ACCOUNT, OR OTHERWISE USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.

  1. 1Eligibility and Account Registration

    1.1

You must be at least 18 years old (or the age of majority in your state) and capable of forming a binding contract to open an account.

    1.2

You agree to provide accurate, current, and complete information during registration and to keep it updated. You are responsible for all activity occurring under your account and for maintaining the confidentiality of your account credentials and PIN.

    1.3

We reserve the right to refuse service, suspend, or terminate accounts at our discretion, including for suspected fraud, non-payment, or violation of these Terms.

  2. 2Description of Services

    2.1

Unlimit Mobile provides prepaid and/or postpaid wireless voice, text, and data services that operate on the Host Network. We do not own the underlying wireless network infrastructure; coverage, speed, and quality depend on the Host Network’s availability and are subject to change without notice to us.

    2.2

Coverage maps, if provided, are estimates only and not a guarantee of service availability at any specific location.

    2.3

References to Unlimit Mobile operating on “T-Mobile Network” describe the performance of the underlying Host Network as measured by independent testing sources (e.g. Speedtest / RootMetrics), and are based on network-level performance rather than a guarantee of individual speed.

    2.4

Services may be affected by geography, terrain, weather, network congestion, maintenance, or Host Network outages, none of which are within our control.

  3. 3Plans, Pricing, and Billing

    3.1

Current plan pricing, data allotments, and features are listed at www.unlimitmobile.com and may change with notice as described in Section 13.

    3.2

Prepaid Plans: Service is provided on a pay-in-advance basis. Your plan expires at the end of the applicable billing cycle unless renewed. Unused data, minutes, or texts do not carry over unless expressly stated and do not entitle you to a refund upon expiration.

    3.3

Postpaid Plans (if applicable): You authorize us to charge your designated payment method on a recurring monthly basis. Late or failed payments may result in suspension of Services.

    3.4

All fees are exclusive of applicable federal, state, and local taxes, and regulatory fees (including USF contributions, 911 fees, and telecom surcharges).

    3.5

Autopay/auto-renewal, where enabled, may be cancelled at any time through your account settings prior to the next billing date.

    3.6

Refunds are provided only where required by law or expressly stated in a plan’s terms. Activation fees, SIM/eSIM kit fees, and used service periods are generally non-refundable.

    Good to know

Prepaid plans expire at the end of their billing cycle unless you renew, and unused data, minutes or texts don’t carry over unless stated otherwise (3.2).

  4. 4Fair Use, Network Management, and Deprioritization

    4.1

Plans marketed as “unlimited” are subject to Unlimit Mobile’s and the Host Network’s fair use and network management policies. After a specified high-speed data threshold, data speeds may be reduced or deprioritized relative to other traffic, particularly in congested areas.

    4.2

Certain uses — including tethering/mobile hotspot beyond plan allotments, commercial resale, machine-to-machine use on consumer plans, or use inconsistent with typical consumer usage patterns — are prohibited unless expressly permitted.

    4.3

We reserve the right to manage network traffic reasonably and in accordance with FCC open internet rules.

  5. 5Devices, SIM Cards, and eSIMs

    5.1

Devices sold by Unlimit Mobile may be locked to the Host Network for a period as disclosed at the time of sale, consistent with applicable FCC device unlocking rules. Unlocking requests will be honored once eligibility conditions are met.

    5.2

You are responsible for ensuring any device you bring to Unlimit Mobile (“Bring Your Own Device”) is compatible with technical requirements.

    5.3

Lost, stolen, or damaged SIM cards/eSIMs may be replaced for a fee.

  6. 6Number Porting

    6.1

You may port an existing phone number to Unlimit Mobile, or port your number away to another carrier, subject to FCC number portability rules. We do not charge a fee to port a number away.

    6.2

Porting delays or failures caused by incorrect account information or third-party carriers are outside our control.

  7. 7Emergency Calling (911) Disclosures

    7.1

Where technically available via the Host Network, 911 emergency calling may not function during network outages, in areas without coverage, or if your device lacks power.

    7.2

If your service supports location-based 911 routing, location accuracy depends on device, network, and environmental factors.

    7.3

It is your responsibility to have an alternative means of contacting emergency services if Unlimit Mobile Services are unavailable.

  8. 8Acceptable Use Policy

You agree not to use the Services to: (a) violate any law or regulation; (b) transmit unlawful, harassing, defamatory, or fraudulent content; (c) engage in robocalling, spam, or unsolicited telemarketing in violation of TCPA or CAN-SPAM; (d) interfere with the Host Network; (e) engage in SIM-swapping fraud or unauthorized account access; or (f) resell Services without written authorization.

  9. 9Privacy and Customer Proprietary Network Information (CPNI)

    9.1

Our collection, use, and disclosure of your personal information, including CPNI as defined under 47 U.S.C. § 222, is governed by our Privacy Policy at www.unlimitmobile.com/privacy-policy.

    9.2

Residents of California, Virginia, Colorado, Connecticut, Utah, and other states with applicable privacy statutes (e.g., CCPA/CPRA) may have additional rights described in our Privacy Policy.

    9.3

You consent to our use of CPNI to market other Unlimit Mobile products and services unless you opt out.

  10. 10Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNLIMIT MOBILE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

  11. 11Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNLIMIT MOBILE AND ITS OFFICERS, EMPLOYEES, AND THE HOST NETWORK OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR SERVICES IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

  12. 12Dispute Resolution; Binding Arbitration; Class Action Waiver

    12.1

Agreement to Arbitrate. Except for small claims court matters and disputes involving intellectual property, you and Unlimit Mobile agree that any dispute shall be resolved by binding arbitration administered by AAA / JAMS.

    12.2

Class Action Waiver. YOU AND UNLIMIT MOBILE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER.

    12.3

We will notify you when you reach 50%, 80%, and 100% of your data, and any additional data/roaming charges included in your plan, and will cap additional data overage charges at $50/month and international roaming charges at $100/month unless you expressly opt in to exceed these caps.

    3.5

Trial Period. You may cancel a new contract within 15 days (or 30 days in Quebec, per the Consumer Protection Act) without penalty if you have used less than the applicable usage threshold set by the Wireless Code/provincial law, and return any device in near-new condition for a refund less a reasonable usage fee.

    Good to know

We’ll alert you at 50%, 80% and 100% of your data, and cap additional data overage charges at $50/month and international roaming charges at $100/month unless you expressly opt in to go over (3.4).

    4.3

Postpaid Plans: You authorize recurring charges to your designated payment method. We will provide bills in plain language as required by the Wireless Code.

    4.4

Refunds are provided as required by the Wireless Code, applicable provincial consumer protection legislation, or as expressly stated in your plan terms.

  5. 5Fair Use and Network Management

    5.1

“Unlimited” plans are subject to fair use and network management policies, including data throttling/deprioritization after a disclosed threshold, particularly in periods of network congestion, consistent with CRTC net neutrality rules.

    5.2

Commercial resale, machine-to-machine use, or use inconsistent with typical consumer patterns on a consumer plan is prohibited unless expressly permitted by your plan.

  6. 6Devices, SIM Cards, and eSIMs

    6.1

You are responsible for ensuring compatibility of any device brought to Unlimit Mobile with the Host Network’s technical requirements (including band compatibility and VoLTE/HD Voice support).

    6.2

Lost, stolen, or damaged SIM/eSIM replacements may incur a fee as disclosed at time of request.

Our collection, use, and disclosure of your personal information is governed by our Privacy Policy at www.unlimitmobile.com/privacy-policy, which complies with the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and applicable provincial privacy legislation (e.g., Quebec’s Law 25).

    10.2

TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. NOTHING IN THESE TERMS LIMITS ANY WARRANTY OR CONDITION IMPLIED BY LAW THAT CANNOT LAWFULLY BE EXCLUDED, INCLUDING UNDER PROVINCIAL CONSUMER PROTECTION STATUTES.

  12. 12Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNLIMIT MOBILE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID FOR SERVICES IN THE THREE (3) MONTHS PRECEDING THE CLAIM. THIS SECTION DOES NOT LIMIT LIABILITY WHERE PROHIBITED BY APPLICABLE PROVINCIAL CONSUMER PROTECTION LAW (INCLUDING QUEBEC’S CONSUMER PROTECTION ACT).

  13. 13Dispute Resolution

    13.1

We encourage you to first contact our Customer Support team to resolve any dispute. If unresolved, you may escalate to the Commission for Complaints for Telecom-Television Services (“CCTS”), an independent complaint-resolution body, free of charge, at www.ccts-cprst.ca.

    13.2

Nothing in these Terms limits your right to bring a claim in small claims court or, in Quebec, exercise your rights under the Consumer Protection Act. Mandatory arbitration clauses that would prevent you from accessing the courts are not enforced against consumers where prohibited by provincial law.

    Complaint not resolved?

After contacting our Customer Support team, you can escalate to the CCTS, an independent complaint-resolution body, free of charge at www.ccts-cprst.ca (13.1).

  15. 15Suspension and Termination

We may suspend or terminate Services for non-payment, fraud, or breach of these Terms, subject to the notice periods required by the Wireless Code. You may cancel at any time; early cancellation fees, if any, will not exceed the balance of any device subsidy being recovered, amortized over a maximum 24-month period.

  16. 16Governing Law

These Terms are governed by the laws of Canada and the applicable provincial laws therein.
